& Conditions
The following terms and
conditions are to protect both the company and each of it's
clients. By ordering any of the services
offered by 121WebDesigner.com you acknowledge agreement to the
following terms and conditions.

Client = The person paying for the services.

1. Our Guarantee
We guarantee to provide the service as described throughout our website at the listed price. From time to time we might include additional extras free of charge at the request of the customer, and we guarantee we will never charge a fee for anything listed as being included.
2. Domain Names
(specific to our website design packages)
a. Provided by the customer.
If the customer chooses to use a domain name they already own the company will accept no responsibility for the renewal of such a domain. Renewal of customer owned domain names is the sole responsibility of the customer.
b. Provided by the company.
As part of the setup of your account the company offers use of a domain name, allowing the customer to choose the domain name at the expense of the company. Renewal of such domain names is the responsibility of the company, with the fee of £12.99/year passed to the customer 1 month prior to renewal. This applies to .co.uk and .com extensions only, other extensions are exempt from these terms.
3. Right To Refuse
The company reserves the right to refuse orders and/or
additional tasks for any reason. The company will not provide services for illegal content websites (ie. promoting violence of any kind, including an intolerance for race, lifestyle, or faith, or that constitutes harassment, defamation, libel, slander, or promotes the commission of a crime or any unlawful conduct). The company reserves the right to refuse/cancel any order with any person or entity without liability and without
explanation.
4. Hosting (specific
to our website design packages)
1. eCommerce Websites
a. Using your own hosting or
that of another provider.
We cannot be held responsible
for the upkeep of your hosting when hosted by yourself or
another company.
b. Provided by us.
Where the company is responsible for the hosting of the customers
website(s), hosting is included in the monthly subscription fee with features detailed on our website. In rare cases the hosting may need upgrading to adapt fully to the customers needs and the popularity of their website, in such an event hosting upgrades will be offered for a minimal fee.
2. eBay Shops
The images and files used in
our eBay shop designs are usually hosted by us free of charge.
If desired the client is free to host the images wherever they
want. These images
and files will only be removed if requested by the client, when
they're no longer in use or when legally obligated. Any client can at any time request a
copy of these images.
5. Copyright & Design
Rights
Modification or alteration of
any kind to CSS, HTML and/or Graphics created by us is strictly
forbidden without prior written (email will suffice) permission
from us.
Unless otherwise agreed, a 'Designed by 121WebDesigner.com' or
similar link will be displayed on the design we create for you.
Removal of this link is not permitted unless we agree in writing
(email will suffice). Breaching this condition may result in
removal or modification of files and/or legal action.
6. Resellers
Agents or persons acting on
behalf of our resellers accept full responsibility for their
customers. Our company shall not be held responsible for any
disagreement between our clients and their customers.
7. Cancellations &
Refunds
The services we provide are
classed as 'digital'. Full and partial refunds are available at
the discretion of the company.
8. Timescales
We reserve the right to
discontinue any service where the client has caused a delay of
more than 90 days.
9. Third-Party Alterations
Where a third-party is involved
we hold zero responsibility for any of the services they provide
to you. This includes but is not limited to hosting companies
changing their terms/services, software providers
upgrading/downgrading their software, suppliers changing their
terms/prices, and any other relevant change with regard to the
service we've provided to you.
10. Combo Package
A discounted 'Combo Package'
includes one eBay Shop Design and one matching eCommerce
Website. The overall design used on both products must be the
same unless otherwise agreed, with the exception of design
aspects that can't match. Minor modifications may be offered at
no extra charge.
11. Force Majeure
Neither party shall be deemed in default of this agreement to the extent that performance of its obligations or attempts to cure any breach are delayed or prevented by reason of any act of God, fire, natural disaster, accident, riots, hosting failures, internet downtime, acts of government, or any other cause beyond the reasonable control of such party.
121WebDesigner.com reserves the right to revise the above terms and conditions at any time.
